Terms of Service and Public Offer

1. Who we are and what this is
1.1. These Terms form a public offer between you ("User") and the sole proprietor (individual entrepreneur) Бондаренко Евгений Владимирович, Tax ID (INN) 501818673555, registration no. (OGRNIP) 319508100025585, Russian Federation ("we", "Provider"), and govern your use of ewiday.com (the "Site"). The Site operates on two domains, ewiday.ru (Russian, prices in RUB) and ewiday.com (English, prices in USD/EUR); the contracting party is the same in both cases.
1.2. You accept these Terms by using the Site (including sending an AI request) or by paying for a package. If you do not agree, do not use the Site.

2. The service
2.1. The Site is an online AI generator of presentations and infographics (including marketplace product-card infographics and charts built from tables) based on a text prompt. A free table comparison tool also runs entirely in your browser: it uses no AI and sends nothing to us.
2.2. There are no accounts or registration. Your projects are stored only in your browser (localStorage). We do not keep copies and cannot restore them; clearing browser data deletes them. Export what matters to you.
3. Pricing and access
- Free: 5 AI requests per day per device/IP address. Manual editing is always free.
- Paid access packages for 7 or 30 days: unlimited use within a fair-use limit (up to 50 AI requests per day). A package is a one-time payment, not a subscription, and does not renew automatically.
- Current prices are shown on the Site. Payments are processed by the payment platform lava.top. A package activates immediately after payment and is bound to your browser by a signed token; it can be restored on another device using the invoice/order number from your lava.top receipt.
- Results carry no watermark.
3.1. We may change prices and limits for future purchases; a package you have paid for is provided on the terms in force when you paid.
3.2. The service starts immediately after payment at your express request. See the Payment and Refund Policy for refunds and your withdrawal rights.
4. AI output
4.1. Output is generated automatically by a third-party model (DeepSeek) and may be inaccurate, incomplete, outdated or fabricated. You must check everything before relying on or publishing it. Output is not legal, medical, financial or other professional advice.
4.2. You own the results and may use them commercially. We do not guarantee that output is unique or free of similarity to third-party material.
4.3. You are responsible for having the rights to anything you upload and for ensuring that your use of the output complies with the law and the rules of any marketplace or platform where you publish it.
5. Data sent to the AI provider
5.1. The text of your prompt and the text extracted from attached files (extraction from Word/PDF/Excel happens locally in your browser) is sent through our server to the DeepSeek API (Hangzhou DeepSeek, China). Images and logos never leave your browser.
5.2. Do not upload documents containing personal data of third parties or confidential information. You are responsible for what you submit. See the Privacy Policy.
6. Acceptable use
You must not:
- create or distribute illegal, infringing, deceptive, hateful or sexually explicit content;
- bypass limits (changing IP/devices, forging tokens, reselling access), or use bots or other automated abuse, or place excessive load on the Site;
- attempt unauthorized access to the Site, its server or third-party services.
We may restrict or block access for violations; no refund is due for the blocked period where the violation is established.
7. Windows software
7.1. The Site distributes ScanToPDF (Free edition at no charge; Pro edition as a one-time paid purchase through lava.top, delivered as a downloadable archive) and Runo (a free startup manager).
7.2. The software is provided "as is"; executables are not code-signed, so Windows may show a warning. Runo modifies Windows startup entries: you use it at your own risk and should make a backup or restore point first.
8. Donations
Voluntary donations may be made via DonationAlerts. A donation is not a purchase, gives no extra rights and is non-refundable.
9. Liability
9.1. The Site is provided "as is" and "as available". To the maximum extent permitted by law, we do not warrant uninterrupted operation, accuracy of AI output or fitness for a particular purpose.
9.2. To the maximum extent permitted by law, we are not liable for indirect or consequential damages, lost profit, loss of data (including browser-stored projects), reputational harm, or losses caused by AI errors, acts or failures of third parties (DeepSeek, lava.top, DonationAlerts, the hosting provider, payment systems), force majeure, or your own acts.
9.3. Our total liability is limited to the amount you actually paid for the relevant package (or software), and for free use is excluded to the extent permitted by law.
9.4. Nothing here excludes liability that cannot be excluded by law, or limits mandatory consumer rights you have under the law of your country of residence. See also the Disclaimer.
10. Changes
We may update these Terms by publishing a new version on the Site; it applies from the date of publication to later use. The offer remains valid until withdrawn.
11. Governing law and disputes
11.1. These Terms are governed by the law of the Russian Federation. Mandatory consumer-protection rules of the country where you live are not excluded.
11.2. Before going to court, please send a written claim to evgenybo@bk.ru; we will respond within 30 days.
11.3. Disputes are heard by the court at the Provider's location, except where mandatory law gives a consumer the right to bring proceedings elsewhere (for example, in the courts of their country of residence).
